In our experience, many claims are initially denied because paperwork is incorrect, or because the applicant failed to provide adequate documentation or evidence to support the claim. When you hire us to help you appeal a claims denial, we will carefully review all documents that have been filed so that we can determine whether you need to provide additional information or to challenge the board’s findings.
Our first step will be to set up a benefit review conference (BRC), with a dispute resolution officer who will act as a mediator. We will prepare and file any documents required at this stage of the process, and will be your advocate at the conference. If you don’t get an acceptable resolution at the BRC, we can seek a contested case hearing (CCH). At the contested case hearing, the hearings officer may take testimony from witnesses, but will render a decision.
If you are displeased with the outcome at the contested case hearing, you have the right ask a three-judge panel to review the transcripts of the CCH proceeding. If they deny your appeal, you can take your case to the district court of appeals or to the Texas Supreme Court, if necessary.
