  • How does workers compensation provide benefits after an injury? Workers’ compensation is a form of insurance, paid for by your employer. When you are injured at work, you file a claim, which is paid by your employer’s workers’ compensation insurance carrier.
  • What types of injuries are covered? An injury must occur in the course and scope of employment. Specific injuries not covered include heart attacks, injuries caused by what are considered "acts of God," injuries caused by employee horseplay, injuries sustained through participation in off-duty recreational or social activities, injuries resulting from an intentional attempt to injure oneself or ordinary diseases of life.
  • What must your employer do? Keep a record of all injury reports, notify you of your rights and responsibilities, and keep track of any work missed because of a job-related injury.
  • What must your employer provide you regarding workers compensation coverage? You are entitled to a notice of coverage, as well as a copy of your rights and responsibilities. Your employer must also notify you of your right to choose any doctor from the Approved Doctor List, found online at www.tdi.state.tx.us.
  • What should you do after a workplace injury? You must report your injury immediately. Your department will then complete a first report of injury and submit it to your employer or to your human resources department. If you need to see a doctor, you can choose anyone on the Approved Doctor List. You will also want to obtain written statements from any witnesses.
  • Can you appeal the denial of a claim? Yes. In fact, a high percentage of workers’ compensation claims are initially denied.
