Death and Burial Benefits Under Workers Compensation

When Your Loved One Dies in a Work Related Accident

If your loved one has been killed in a workplace accident or has died from injuries suffered on the job, you have a right to seek benefits to replace the support that person would have provided you. You may think that this would be an open-and-shut case and that your loved one’s employer would do the right thing and move swiftly to provide you with the benefits you need. Unfortunately, many workers’ compensation claims, even for deaths resulting from a workplace accident, are initially denied. To get the benefits you need and deserve, you want an experienced attorney on your side.

The Death and Burial Benefits Available under Workers Compensation

If your loved one died in a workplace accident, you can file a claim under the Texas workers’ compensation laws for benefits to replace a portion of the lost income that person would have provided. You may also be able to get reimbursement for expenses related to funeral and burial services.

You are entitled to seek death benefits the day after your loved one dies in a work-related incident. Benefits can be paid to a surviving spouse or dependent child, to a dependent grandchild or to any other family member who can show they were at least 20 percent financially dependent on the deceased worker.

At Bailey & Galyen, we handle all matters related to your efforts to get death and burial benefits when your family member is killed on the job. We will prepare and file all the necessary documentation required by insurance carriers or the court, and will be your voice in all proceedings in court or before administrative agencies.
